Foreign workers staff convenience stores, factories, farms, construction sites and care homes across Japan. They come through several routes: students working part time, the specified skilled worker visa created in 2019, and until recently the technical intern training program. That program drew criticism over rights abuses, and a law passed in June 2024 abolishes it and replaces it with a new employment and training system.

Japan has a shrinking, aging workforce and has been bringing in workers from abroad for decades, while carefully avoiding the word immigration. Several routes exist side by side. Students on study visas may work limited hours, which is why so many convenience store and restaurant staff in cities are young people from Asia.

In 2019 the specified skilled worker visa opened designated sectors such as care work, food service, agriculture and construction, with a higher tier allowing longer stays and family accompaniment. Alongside these ran the technical intern training program, officially a transfer of skills to developing countries, which in practice supplied factories and farms with labor.

It was criticized at home and abroad over restrictions on changing employer, debt to brokers, unpaid overtime and disappearances. In June 2024 a law passed abolishing that program and creating a new system called ikusei shuro, employment and training, with the right to change employer under conditions. It takes effect within three years of promulgation, so by June 2027 at the latest.

日本は働き手が減り高齢化する中で、何十年も海外から人を迎えてきましたが、「移民」という言葉は慎重に避けてきました。いくつもの道筋が並んで存在します。留学の在留資格の学生は時間を限ってアルバイトができ、都市のコンビニや飲食店の若い店員にアジアから来た人が多いのはそのためです。

2019年には特定技能が設けられ、介護、外食、農業、建設などの分野が開かれ、より上の区分では長い滞在と家族の帯同が認められます。これらと並んで技能実習制度がありました。建前は開発途上国への技能の移転ですが、実際には工場と農場に労働力を供給しました。

転職の制限、仲介業者への借金、残業代の不払い、失踪をめぐって国内外から批判を受けました。2024年6月、この制度を廃止して「育成就労」という新しい仕組みを作る法律が成立し、条件つきで転職できるようになります。施行は公布から三年以内で、遅くとも2027年6月です。

QWhy doesn't Japan call this immigration?

どうして日本はそれを移民と呼ばないのですか。

Because most of the programs are built around fixed-term stays rather than settlement, and successive governments have said the policy is not an immigration policy. In practice many people stay for years, bring families under some visas, and put down roots, so the vocabulary and the reality have drifted apart.

制度の多くが定住ではなく期間を定めた滞在を前提に組まれていて、歴代の政権も移民政策ではないと説明してきたからです。実際には何年も滞在し、在留資格によっては家族を呼び、根を下ろす人が多く、言葉と実態が離れてきています。

QWhat was wrong with the technical intern program?

技能実習制度の何が問題だったのですか。

Its stated purpose was skills transfer, but it functioned as a labor supply. Interns generally could not change employer, which left them dependent on one workplace, and cases of unpaid wages, excessive hours, harassment and large broker debts in home countries were documented. That combination is why it is being replaced.

建前は技能の移転でしたが、実際には労働力の供給として機能しました。実習生は原則として転職できず、一つの職場に依存させられ、賃金の不払い、長時間労働、嫌がらせ、母国での多額の仲介手数料の借金が記録されています。この組み合わせが、置き換えられる理由です。

QCan a foreign worker settle permanently?

外国から来た労働者は、永住できるのですか。

Yes, through some routes. The higher tier of the specified skilled worker visa allows renewal without a fixed limit and family accompaniment, and permanent residency is available after meeting residence and income requirements. Naturalization is a separate process. The easier routes are for people with recognized qualifications or higher skills.

道筋によっては可能です。特定技能の上の区分は更新に上限がなく家族の帯同も認められ、在留期間や収入などの要件を満たせば永住許可を申請できます。帰化は別の手続きです。資格や高い技能が認められる人ほど道は開けています。

豆知識

外国人技能実習制度は開発途上地域への技能移転を目的としていましたが、実態としては人手不足の分野の労働を担い、転職が原則できない仕組みや、送り出し国での多額の手数料をめぐって国内外から批判を受けてきました。2024年6月14日に改正入管法などが成立し、同月21日に公布され、技能実習制度を廃止して「育成就労」の在留資格を創設することが決まりました。制度の目的は、特定技能1号の水準の人材の育成と、その分野での人材の確保に改められます。施行は公布から原則三年以内とされ、具体的な期日は本稿の時点で未定です。2019年に始まった特定技能は分野を限って就労を認めるもので、上位の区分では在留期間の更新に上限がなく家族の帯同も認められます。留学生の資格外活動としてのアルバイトには時間の上限があります。
