Under the Law for the Protection of Cultural Properties of 1950, the state designates important cultural properties — buildings, sculptures, paintings, documents, crafts — and from among them designates national treasures. The law also covers intangible heritage, which is where the holders of designated crafts and performing arts, popularly called living national treasures, come in, as well as folk customs and historic sites.

1950年の文化財保護法にもとづき、国は建造物、彫刻、絵画、文書、工芸などを重要文化財に指定し、その中から国宝を指定します。この法律は無形の文化財も対象とし、指定された工芸や芸能の保持者、いわゆる人間国宝もここに含まれます。民俗の習わしや史跡も同じ枠組みで扱われます。

When a temple tells you that its statue is a national treasure, it helps to know what that means legally. Japan's system rests on a law passed in 1950, and the thing most visitors get wrong is the relationship between the two famous labels. Important cultural property is the broad designation; national treasure is not a parallel category but a selection from within it, given to items of especially high value.

So every national treasure is also an important cultural property, and there are several thousand of the former and over ten thousand of the latter. The law is broader than objects. It covers intangible cultural properties, meaning skills rather than things, which is how a potter or a kabuki actor can be certified as a holder of an important intangible cultural property, the status the press calls a living national treasure.

It also covers folk customs, historic sites, places of scenic beauty and natural monuments, and more recently groups of traditional buildings, which is why some whole streets are preserved. Designation brings repair subsidies and tax treatment, and also restrictions: a designated building cannot be freely altered or exported.

寺で、この像は国宝ですと言われたとき、それが法律上どういう意味かを知っていると役に立ちます。日本の仕組みは1950年の法律にもとづいており、多くの人が取り違えるのは、有名な二つの呼び名の関係です。重要文化財が広いほうの指定で、国宝はそれと並ぶ別の区分ではなく、その中から特に価値の高いものを選んだものです。

ですから国宝はすべて重要文化財でもあり、数は前者が千件台、後者が一万件を超えます。法の対象は物だけではありません。物ではなく技を指す無形文化財も含み、陶工や歌舞伎役者が重要無形文化財の保持者に認定されるのはこの枠です。報道が人間国宝と呼ぶのがこれにあたります。

ほかに民俗、史跡、名勝、天然記念物があり、近年は伝統的建造物群も加わって、町並みごと守られている場所があるのはそのためです。指定されると修理の補助や税の扱いが受けられる一方で、制約もあります。指定された建物は自由に改変できず、国外に持ち出すこともできません。

Earlier protection laws existed from the Meiji period, but the 1950 law followed a fire that damaged the wall paintings of Horyuji temple's main hall the previous year, which caused a national reaction.

明治期から保護の法律はありましたが、1950年の法は、前年に法隆寺金堂の壁画が焼損した出来事を受けて作られました。国民の反響が大きかったためです。

QIs this the same as World Heritage?

世界遺産と同じものですか。

No. World Heritage is a UNESCO listing under an international convention. Japan's designations are domestic law, and a site is usually designated domestically first.

違います。世界遺産は国際条約にもとづくユネスコの登録です。日本の指定は国内法によるもので、多くはまず国内で指定されます。

豆知識

文化財保護法は1950年(昭和25年)に制定された。前年の1949年に法隆寺金堂の壁画が焼損したことが、制定を急がせた出来事として知られる。指定は文部科学大臣が行い、文化審議会の答申にもとづく。国宝は重要文化財のうち特に価値の高いものとして指定される仕組みで、建造物・美術工芸品を合わせて千件台、重要文化財は一万件を超える。国宝・重要文化財は国外への輸出が原則として禁じられている。
