Non-regular workers now make up close to four in ten employees. They often do similar work for lower pay, fewer bonuses and less security.

To understand work in Japan you have to know that there are two tracks. Regular employment means being hired without a fixed end date, trained by the company, moved between departments and paid on a scale that rises with years of service.

Non-regular employment covers fixed-term contracts, part-time work and dispatched work through an agency, and it now accounts for close to four in ten employees according to the government labor force survey. The split matters because the two groups can sit side by side doing similar work with very different pay, bonuses and job security.

Women and older workers are overrepresented on the non-regular side. Laws have been tightened to require equal treatment for equal work and to let long-serving fixed-term staff convert to open-ended contracts, and those rules have changed some workplaces. The underlying two-track structure, however, is still there, and it is one of the most discussed problems in Japanese working life.

日本の働き方を理解するには、二つの道があることを知る必要があります。正規雇用とは、終わりの期日を定めずに採用され、会社に育てられ、部署を移りながら、勤続年数とともに上がる賃金表で払われることです。

非正規雇用は、有期契約、パート、派遣会社を通じた働き方を含み、政府の労働力調査によれば今や雇用者の四割近くを占めます。この分かれ方が問題なのは、二つの集団が隣り合って似た仕事をしながら、賃金も賞与も雇用の安定もまるで違いうるからです。

女性と高齢の働き手は非正規の側に偏っています。同じ仕事には同じ待遇をと求める法律や、有期契約が長く続いた人が無期契約に変われる仕組みが整えられ、それによって変わった職場もあります。しかし、二本立てという土台は今も残っており、日本の働き方で最も語られる問題の一つです。

非正規雇用とはパートタイムのことですか。

No. Part-time is one kind. Non-regular also includes people working full hours on a one-year contract and people employed by a dispatch agency but working in a client's office, both of which can be full-time.

違います。パートはその一種です。非正規には、一年契約でフルタイムに働く人や、派遣会社に雇われて取引先の職場で働く人も含まれ、どちらも常勤でありえます。

QCan someone move from non-regular to regular?

非正規から正社員になれるのですか。

Yes, and it happens more than it used to. A fixed-term worker who has been renewed past five years can request conversion to an open-ended contract, and companies short of staff now hire from their own non-regular ranks.

できますし、以前より多くなりました。有期契約が通算五年を超えて更新された人は、無期契約への転換を申し込めます。人手の足りない会社は、自社の非正規から採用するようにもなっています。

QWhy did it grow so much?

どうしてここまで増えたのですか。

It expanded during the long slump after the 1990s, when companies protected existing regular staff by hiring flexibly instead. Rules on dispatched work were also loosened over the same period.

1990年代以降の長い不況の中で広がりました。企業が既存の正社員を守るため、代わりに調整しやすい形で採用したからです。同じ時期に、派遣で働くことについての規制も緩められました。

豆知識

総務省の労働力調査によれば、役員を除く雇用者のうち非正規の割合は近年四割弱で推移しています。労働契約法により、有期契約が通算五年を超えて更新された労働者は、無期労働契約への転換を申し込むことができます。またパートタイム・有期雇用労働法により、同じ仕事に不合理な待遇差を設けることが禁じられ、大企業では2020年から、中小企業では2021年から適用されました。非正規は女性と高齢者に多く、世帯の収入構造とも関係しています。
