Japanese employees are legally entitled to paid annual leave, starting at ten days after six months and rising with service. The problem has never been the entitlement but the take-up. For decades around half went unused, because taking leave meant passing work to colleagues. Since 2019, employers have been legally required to make workers take at least five days a year.

Japanese workers get paid annual leave by law: ten days after six months of employment, rising with years of service to twenty days. On paper that is not unusual. What has been unusual is how little of it people used.

For a long time roughly half of all paid leave went unused every year, and Japan appeared at the bottom of international surveys on this. The reasons given were consistent. Taking a day off means your work goes to a colleague, so it feels like imposing. Nobody else is taking theirs, so taking yours looks conspicuous.

And when you return, the work is still there. In 2019 the law changed: employers must now ensure each worker takes at least five days a year, and they can be fined if they do not. Take-up has risen since. It is a small thing, but it shows something useful: the problem was never that Japanese people did not want to rest.

日本の労働者には法律で有給休暇が与えられます。勤続6か月で10日、年数とともに増えて最大20日。制度としては珍しくありません。珍しかったのは、その使われなさです。

長いあいだ毎年およそ半分が消化されず、国際比較の調査で日本は最下位に並びました。理由はいつも同じでした。休めば仕事は同僚に回り、迷惑をかける気がする。誰も取っていないので、自分が取ると目立つ。そして戻れば仕事はそのまま残っている。

2019年に法律が変わり、企業は労働者に年5日を取得させる義務を負い、守らなければ罰則があります。以後、取得率は上がりました。小さなことですが、大事なことを示しています。問題は、日本人が休みたくなかったことでは一度もなかった、ということです。

Legally, no; the reason is not required. In practice many people invent one anyway, because saying "no particular reason" still feels awkward in some workplaces.

法律上は理由を言う必要はありません。ただ実際には理由を作る人が多く、「とくに理由はありません」と言いにくい職場がまだあります。

QWhat about sick leave?

病気で休むときはどうなりますか。

Japan generally has no separate statutory sick leave, so people use their paid annual leave when ill. That is a large part of why annual leave gets used up on illness rather than holidays.

日本には原則として法定の病気休暇が別にないため、体調を崩したときは年次有給休暇を使います。有給が旅行ではなく病気で消える大きな理由です。

QIs the five-day rule working?

五日の義務化はうまくいっていますか。

Take-up rates have risen noticeably since it came in. Critics point out that five days out of twenty is a low bar, but it changed the default from nobody taking leave to everybody taking some.

導入後、取得率は目に見えて上がりました。20日のうち5日は低い基準だという批判もありますが、「誰も取らない」から「全員が少しは取る」へ既定値を変えた効果はありました。

豆知識

労働基準法では、雇い入れから6か月継続勤務し全労働日の8割以上出勤した労働者に10日の年次有給休暇を与えると定めている。勤続6年6か月以上で年20日が上限。厚生労働省の就労条件総合調査によると、取得率は長く50%前後で推移していたが、2019年4月に年5日の取得が企業の義務となって以降上昇し、直近では6割台後半に達している。日本に法定の病気休暇制度がないことは国際的には珍しく、有給休暇が病欠に使われる構造的な理由になっている。なお祝日の数は日本が世界的に見て多い部類に入り、長期休暇より飛び石の連休で休む形が定着している。
