Japan's burial law was written on the assumption that remains go into a grave, and it does not address scattering at all. In practice scattering at sea is carried out by specialist operators following guidelines issued by the health ministry in 2021: remains must be powdered, done well offshore, and away from fishing grounds. Some municipalities restrict scattering on land by local ordinance.

Sankotsu is a good example of something that operates in a legal gap rather than under a rule. Japan's law on graves and burial was written on the assumption that cremated remains are placed in a licensed cemetery, and it simply does not mention scattering, so for decades the position was unclear.

What resolved it in practice was not legislation but guidance: the health ministry issued a set of guidelines for scattering at sea in 2021, and operators follow them. The main requirements are that the remains be ground to powder so they are no longer identifiable as bone, that the scattering happen well offshore rather than from a beach, and that fishing grounds, shipping lanes and aquaculture areas be avoided.

On land the picture is messier, because some municipalities have passed ordinances restricting or banning it after local objections, so it depends where you are. Demand has grown along with the difficulty of maintaining family graves, and it is often combined with keeping a small portion of the remains at home, which is legal and increasingly common.

散骨は、決まりの下ではなく、法の隙間で動いているものの良い例です。日本の墓地埋葬法は、火葬した遺骨は許可された墓地に納めるという前提で書かれており、まくことについては何も触れていません。ですから長いあいだ、扱いが曖昧でした。

豆知識

墓地、埋葬等に関する法律には散骨についての規定がなく、1991年に法務省が「節度をもって行われる限り問題ない」との見解を示したことが、実務上の転機として語られる。厚生労働省は2021年3月に「散骨に関するガイドライン」を公表し、焼骨を二ミリ以下に粉砕すること、陸からの距離や漁業への配慮などを示した。北海道長沼町など、陸上での散骨を条例で規制する自治体がある。
