If both spouses agree, a Japanese divorce is done by submitting a form signed by both to the local city office. This is called divorce by agreement and accounts for the large majority of cases. If they cannot agree, the next step is mediation at a family court, and only then litigation. Japan has no joint custody after divorce in the traditional system, though a law to allow it has been passed and is due to take effect.

Divorce in Japan is administratively simple and legally distinctive. If both spouses agree, they fill in one form, both sign and seal it, two witnesses sign, and it is submitted to the city office. No judge, no lawyer, no waiting period. This is divorce by agreement, and it covers the large majority of Japanese divorces.

If agreement fails, you cannot go straight to court: family court mediation comes first, where a panel shuttles between the parties, and litigation is the last resort. Two features surprise people from other countries. First, the paperwork's simplicity means a divorce can be filed by one spouse forging the other's part, so there is a procedure to register an objection in advance.

Second, custody after divorce has been sole custody only, granted to one parent, and contact with the other parent has depended heavily on that parent's cooperation. A law passed in 2024 introduces the option of joint parental authority and is due to take effect within two years of promulgation. Child support payments have historically had a low rate of being received.

日本の離婚は手続きが簡単で、法制度としては独特です。夫婦の合意があれば、一枚の届に双方が署名押印し、証人二人が署名して、役所に出すだけです。裁判官も弁護士も待機期間も要りません。これが協議離婚で、日本の離婚の大多数を占めます。合意できない場合、いきなり裁判にはできません。

まず家庭裁判所の調停があり、調停委員が双方の間を行き来し、訴訟は最後の手段です。他国の人が驚く点が二つあります。第一に、手続きが簡単なぶん、一方が相手の欄を偽って提出することもありえるため、あらかじめ受理しないよう申し出る手続きが用意されています。

第二に、離婚後の親権は一方の親だけに与えられる単独親権で、もう一方の親と子の交流は、その親の協力に大きく左右されてきました。2024年に成立した法律で共同親権を選べるようになり、公布から二年以内に施行されることになっています。養育費が実際に支払われる割合は、これまで低い水準にとどまってきました。

Much less than a generation ago, especially in cities, and there is even a word for the paperwork day treated as a fresh start. But it can still affect how families talk about a person, and single parents, most often mothers, face real economic difficulty, which is a documented problem rather than a matter of attitude.
