Article 750 of the Civil Code says a married couple takes the surname of the husband or the wife. It does not specify which, but in practice about 95 percent of couples choose the husband's. Campaigners want an option to keep separate surnames. The Supreme Court has twice held the rule constitutional while saying the matter is for parliament to decide.

Japan requires a married couple to have the same surname. The Civil Code does not say whose, so the rule is formally neutral, but about ninety-five percent of couples take the husband's name, which means in practice it is women who change. The consequences are ordinary and cumulative: reissuing a passport, a driving license, bank accounts, published research under a previous name.

What campaigners ask for is not compulsory separate surnames but an option, which is why the proposal is called selective. The Supreme Court considered it in 2015 and again in 2021 and held the rule constitutional both times, while saying that whether to change it is a matter for the Diet.

In the 2021 decision four of fifteen judges dissented. Many workplaces now let people use their former name at work, which softens the problem without solving the legal one. Opinion in Japan is genuinely divided, including within families.

日本では、結婚した夫婦は同じ姓を名乗らなければなりません。民法はどちらの姓とは書いていないので、規定そのものは中立です。しかし実際には約95%の夫婦が夫の姓を選びます。つまり、変えるのは女性です。影響は地味で、しかも積み重なります。

Yes, if you are not a Japanese national. The same-surname rule applies between two Japanese nationals. In an international marriage the Japanese spouse keeps their surname by default and may apply to change it within six months.

日本国籍でなければ、そのままで問題ありません。同姓の決まりは日本人どうしの婚姻に適用されます。国際結婚では、日本人の側は原則としてそのままの姓で、希望すれば六か月以内に変更を申し出られます。

旧姓を使い続ける方法とは何ですか。

Using the former surname at work while the legal name is the married one. It can now be shown alongside the legal name on a residence record, a driving license and a passport, which reduces friction but does not change the legal position.

法律上は婚姻後の姓のまま、職場では旧姓を使い続ける形です。住民票、運転免許証、旅券に旧姓を併記できるようになり、不便は減りましたが、法的な立場が変わるわけではありません。

Those against say a shared surname expresses family unity and that different surnames within a household could affect children. Those in favor point to the burden falling on one sex and to the option being voluntary. Both positions are held here.

豆知識

民法750条は「夫婦は、婚姻の際に定めるところに従い、夫又は妻の氏を称する」と定める。厚生労働省の人口動態統計では、2023年に夫の氏を選んだ夫婦は94.5パーセントだった。法制審議会は平成8年(1996年)に選択的夫婦別氏制度の導入を含む民法改正案を答申したが、法案は提出されていない。最高裁大法廷は平成27年(2015年)と令和3年(2021年)に合憲と判断し、制度のあり方は国会で論じられるべきだとした。2021年の決定では15人の裁判官のうち4人が違憲の意見を述べている。
