The shortest answer that works

Japanese law requires a married couple to share one surname, and in about 95 percent of cases the wife changes hers.

The standard explanation

Article 750 of the Civil Code says a married couple takes the surname of the husband or the wife. It does not specify which, but in practice about 95 percent of couples choose the husband's. Some people call for an option to keep separate surnames, while others say one shared name expresses family unity. The Supreme Court has twice held the rule constitutional, saying the matter is for parliament to decide.

A full paragraph you can read aloud

Japan requires a married couple to share one surname. The Civil Code does not say whose, but about ninety-five percent of couples take the husband's name, so in practice it is mostly women who change. Some people want an option for couples to keep separate surnames.

They point to the work of renewing passports, bank accounts and licenses, and to careers built under a former name. Others prefer the current rule. They say a shared surname expresses family unity, and they worry about how children's surnames would be decided and how it would affect them.

The Supreme Court upheld the rule in 2015 and 2021, saying the question is for the Diet to decide. Using a former name at work is now widely accepted, and some see expanding that as the answer. Opinion in Japan is divided, even within families.

Questions people actually ask

And how to answer them.

Q

Can I keep my own surname if I marry a Japanese national?

Yes, if you are not a Japanese national. The same-surname rule applies between two Japanese nationals. In an international marriage the Japanese spouse keeps their surname by default and may apply to change it within six months.

Q

What is the maiden name workaround?

Using the former surname at work while the legal name is the married one. It can now be shown alongside the legal name on a residence record, a driver's license and a passport, which reduces friction but does not change the legal position.

Q

What is the argument against changing the law?

Those against say a shared surname expresses family unity and that different surnames within a household could affect children, and some propose widening the legal use of former names instead. Those in favor point to the burden falling mostly on women and to the option being voluntary. Both views are held in Japan.
