裁判などで、ある事実が本当であることを証拠によって示さなければならない責任のこと。刑事裁判では、被告人が有罪であることを証明する責任は検察の側にある。ニュースでは裁判の話題のほか、政策や科学的な主張をめぐる議論で「根拠を示すべきなのはどちらか」を語るときにも使われる。
