Japan is the only G7 country without legal recognition of same-sex marriage, and the situation is genuinely in motion, so it is worth being precise. Marriage law is national and does not permit it. From 2015 local governments began issuing partnership certificates, and by 2024 more than four hundred municipalities had them, covering over eighty percent of the population.

They help with hospital visits and municipal housing, but they are not marriage: no inheritance rights, no joint parental authority, no spousal visa. Meanwhile couples have sued. Starting with Sapporo in 2021 and continuing through high court rulings in Sapporo, Tokyo, Fukuoka, Nagoya and Osaka, courts have held the absence of legal marriage unconstitutional, mostly under the equality clause.

In late 2025 a second Tokyo High Court panel went the other way and found it constitutional. The cases are now at the Supreme Court. Opinion polls here show majority support, and parliament has not acted.

QWhat does a partnership certificate actually do?

It helps with things the municipality or cooperating companies control: hospital visiting rights, applying for public housing together, some employer benefits. It does not create inheritance, tax or immigration status.

QIf courts say it's unconstitutional, why hasn't it changed?

Japanese courts can declare a situation unconstitutional but cannot write the law. Legislation is for the Diet, and the rulings have not so far produced a bill. The Supreme Court's decision is what everyone is waiting for.

QIs Japan hostile to LGBT people?

Not in the way that word suggests. There is no criminalisation and little organized religious opposition, and surveys show majority support for marriage. The obstacle is legislative inertia rather than open hostility.

パートナーシップ制度は平成27年(2015年)に渋谷区と世田谷区で始まり、令和6年(2024年)6月時点で459の自治体が導入し、人口の85パーセント以上をカバーしている。「結婚の自由をすべての人に」訴訟は全国5か所で起こされ、令和6年(2024年)3月の札幌高裁を皮切りに、東京・福岡・名古屋・大阪の各高裁が憲法14条1項や24条2項に反すると判断した。福岡高裁は幸福追求権を定めた13条にも触れている。一方、令和7年(2025年)11月の東京高裁の別の訴訟では合憲の判断が示された。これらは最高裁大法廷で審理されている。
