The Imperial House Law of 1947 says the throne passes to a male of the imperial line descended through males. There are sixteen members of the imperial family and only three with succession rights, with one in the younger generation. A law passed in July 2026 lets female members keep their status after marriage and allows certain adoptions, but it did not change who may become emperor.

The rule is simple to state and the consequence is not. Under the Imperial House Law, the throne passes to a male who descends from the imperial line through males only. A daughter of an emperor cannot inherit, and until recently she also left the imperial family on marriage. The result is arithmetic.

The imperial family now has sixteen members, eleven of them women, and only three men hold succession rights: the Emperor's younger brother, that brother's teenage son, and an uncle in his eighties. A government panel in 2005 proposed allowing female and female-line succession, and the debate stopped when a boy was born the following year.

In 2017 a special law allowed the previous emperor to abdicate, which happened in 2019 and was the first abdication in about two centuries. In July 2026 parliament passed a law letting female members stay in the imperial family after marrying, and allowing adoption of male-line males from families that left the imperial house in 1947. That addresses the number of imperial family members. It does not address who may reign.

昭和22年(1947年)の皇室典範は「皇位は、皇統に属する男系の男子が、これを継承する」と定める。平成17年(2005年)、政府の有識者会議は女性天皇と女系天皇を認める報告をまとめたが、翌年の悠仁親王の誕生を受けて議論は進まなかった。平成29年(2017年)の特例法により、平成31年(2019年)に約200年ぶりの譲位が行われた。令和8年(2026年)7月17日、皇室典範の改正法が成立し、女性皇族が婚姻後も本人の意思で身分を保てること、旧宮家の男系男子を養子に迎えられることが定められた。養子本人に継承資格はないが、その男子の子孫には及ぶ。
