The standard explanation

Japan is one of the few developed countries that still executes. The method is hanging, carried out in seven detention centers. A government survey found about 83 percent saying capital punishment is unavoidable and about 17 percent that it should be abolished. Executions are not announced in advance, and the condemned person is told on the morning itself.

This question comes up more than Japanese people expect, and answering it badly damages a conversation. Here are the facts. Japan retains capital punishment for aggravated murder, and among OECD countries only Japan, the United States and South Korea still have it, with South Korea not having executed for decades.

The method is hanging, at seven detention centers. The most recent government survey found around 83 percent saying it is unavoidable and around 17 percent saying it should be abolished, with concern about wrongful conviction the main reason given by the second group.

The feature that draws the strongest criticism abroad is the procedure: executions are not announced in advance, families are informed afterwards, and the person is told on the morning of the day. Supporters point to victims' families and to public opinion. Opponents point to wrongful convictions, and Japan has had exonerations after decades on death row. I would give the facts and say clearly that opinion here is not unanimous.

Questions people actually ask

And how to answer them.

QHow many people are on death row?

Around a hundred at any given time. Executions have been carried out in some years and not others; there have been years with none at all, which varies with the justice minister in office.

QIs there a life sentence without parole instead?

Japan has no life imprisonment without the possibility of parole. The heaviest sentence below death is indefinite imprisonment, which allows parole in principle, and the absence of a true life sentence is part of the domestic debate.

QHave there been wrongful convictions?

Yes. Several people sentenced to death have been acquitted at retrial, in some cases after decades in custody. These cases are the strongest argument used by abolitionists here.

A common misunderstanding

MYTHJapan has the death penalty because Japanese culture values harsh punishment.

FACTThe main reasons given in surveys are consideration for victims' families and public opinion, not a cultural preference for severity. Abolition is debated here, and support has been slowly declining in some surveys.
