This is one of the areas where Japan's system differs sharply from other developed countries, and it is worth stating plainly. If a person loses their residence status, for example after an asylum claim is rejected or a visa expires, they can be held in an immigration detention center until deportation. Two features stand out.
There is no maximum period set in law, so detention can run for months or years, and no judge reviews the decision; the immigration bureau decides and also reviews its own decision. Conditions and medical care have been criticised for years, and in March 2021 a Sri Lankan woman named Wishma Sandamali died in the Nagoya facility after repeatedly asking for hospital treatment.
The government's own investigation found failings, and the case reshaped the debate. A 2023 amendment created a supervision arrangement allowing release under a supervisor, but the decision still rests with the immigration bureau, which is the core of the continuing criticism.

QDid anything change after 2021?
Medical staffing was increased and the bureau published reform measures. The 2023 law added the supervision alternative and also allowed deportation after a third asylum application. Whether that balance is right is what people argue about.
