To what extent should works created with AI be protected by copyright?

I believe AI-assisted works should be protected to a large extent, as long as a human has made meaningful creative choices.

  1. human effortMany people spend a lot of time writing instructions, selecting results, and editing AI output. Their creative effort deserves some legal protection.
  2. investmentWithout copyright protection, companies may not invest in creative projects that use AI. A game studio using AI tools, for example, needs to know that its work cannot be freely copied.
  3. clear rulesClear protection would reduce confusion and legal disputes. Creators and businesses could use AI with confidence if they knew exactly what they owned.

I believe works created mainly by AI should be protected only to a very limited extent, if at all.

  1. human creativityCopyright exists to reward human creativity. The US Copyright Office, for example, has taken the position that a work needs human authorship to be protected.
  2. fairness to artistsAI systems are often trained on huge amounts of human-made work. Giving strong rights to AI output could harm the very artists whose work made it possible.
  3. flood of contentAI can produce countless images and texts in seconds. If all of them were protected, it could become very difficult for human creators to avoid accidentally copying something.

QWhat about someone who uses AI as a tool, like a photographer uses a camera?

That's a good comparison. Admittedly, photographers use machines too, and their work is protected. However, a photographer chooses the scene, the angle, and the timing. So I think AI-assisted work should be protected only when the human makes similar creative decisions, not when they simply type a short request.

QWho should own the copyright of an AI-assisted work, the user or the AI company?

I think it should belong to the user who made the creative choices, not the company that built the tool. A company that makes word-processing software, for example, does not own the novels written with it. Of course, users should also check the terms of each AI service, because some companies set their own conditions.

QWill AI replace human artists?

I don't think it will completely replace them. AI can produce images quickly, but people still value the story and personality behind a human artist's work. However, some jobs, such as simple illustration work, may decrease, so artists may need to adapt.
