離婚

rikonhow divorce works in Japan
Standard
Two adults calmly discussing practical arrangements during divorce mediation.

Rikon, or divorce, is usually done in Japan by filing a single form at a city office, with no court.

If both spouses agree, a Japanese divorce is done by submitting a form signed by both to the local city office. This is called divorce by agreement and accounts for the large majority of cases. If they cannot agree, family court mediation comes first, and only then litigation. Since April 2026, parents can also choose joint parental authority after divorce, a change on which opinion was divided.

参As a short speechスピーチ・英作文

Divorce in Japan is administratively simple. If both spouses agree, they fill in one form, both sign it, two witnesses sign, and it is submitted to the city office, with no judge or waiting period. This divorce by agreement covers the large majority of cases.

If agreement fails, family court mediation comes first, and litigation is the last resort. Custody has been the biggest recent change. Until March 2026, only one parent could hold parental authority after divorce. Since April 2026, parents may choose joint authority, and a family court decides when they disagree.

Supporters say children benefit from staying connected to both parents. Others worry that victims of domestic violence could stay tied to an abusive former partner, so the law requires sole authority where abuse is a risk. How it works in practice is being watched.

離婚りこんrikonhow divorce works in Japan

In one line

In 30 seconds

As a short speech

Questions people actually ask

QReally just one form?

AYes, for divorce by agreement. Both spouses sign it, two adult witnesses sign, and it goes to the city office. The couple must also decide who holds parental authority over any minor children, and the form cannot be accepted without that entry.

QWhat happens to the children?

AUntil March 2026, parental authority went to only one parent after divorce. Since April 2026, parents can agree on joint authority, or a family court decides, and the court must choose sole authority where there is a risk of abuse or domestic violence. Supporters and critics of the change still see its effects differently.

QIs divorce still seen as shameful?

AMuch less than a generation ago, especially in cities, and some people now talk openly about it as a fresh start. But it can still affect how families talk about a person, and single parents, most often mothers, face real economic difficulty, which is a documented problem rather than a matter of attitude.

A common misunderstanding

MYTHGetting divorced anywhere means going to court.

FACTIn Japan, divorce by mutual agreement is completed by filing a form at a city office, and the large majority of divorces never involve a judge.

Background
