harasumentoworkplace harassment and the law against it
Standard
An employee seeking support from a colleague after workplace harassment.

Harasumento, or harassment, is classified into named types in Japanese workplaces, and employers are legally required to prevent it.

Japanese has a set of compound words for harassment at work: pawahara for abuse of position, sekuhara for sexual harassment, matahara for mistreating pregnant staff. A revised labor law made preventing abuse of position a legal duty for large companies in June 2020 and for smaller ones in April 2022. Companies must set a policy and provide a place to report. There are no fines, but the ministry can publish the name of a firm that ignores guidance.

参As a short speechスピーチ・英作文

If you work in Japan you will quickly learn a family of words ending in hara. Pawahara, from power harassment, means abusing your position over a subordinate: shouting, impossible demands, excluding someone from work. Sekuhara is sexual harassment. Matahara is disadvantaging a woman because she is pregnant or has taken maternity leave.

There are joking coinages too, but the main three are legal categories. A revision to the labor policy law made preventing power harassment a duty for employers, applying to large companies from June 2020 and to small and medium ones from April 2022.

Companies must state a policy, train managers and provide a consultation desk, and the guidance sets out six typical patterns of what counts. The law carries no fine; the ministry can advise, instruct and recommend, and publish the name of a company that ignores a recommendation. Whether this changes behavior is debated, but the vocabulary alone has changed what people feel able to name.

ハラスメントはらすめんとharasumentoworkplace harassment and the law against it

In one line

In 30 seconds

As a short speech

Questions people actually ask

QWhat counts as power harassment, exactly?

AThe guidance describes it as conduct that uses a superior position, goes beyond what is necessary for the work, and harms the employee's environment. Six patterns are listed, including physical attack, verbal abuse, isolation, unreasonable demands, giving too little or meaningless work, and intruding into private life. Ordinary strict instruction is not harassment.

QWhat should I do if it happens to me?

AWrite down what happened with dates and witnesses, and use the company's consultation desk, which the law requires. If that fails, prefectural labor bureaus run free consultation counters and a dispute resolution service for individuals. Unions and lawyers are the next step.

QWhy are there so many words ending in hara?

ABecause sekuhara caught on in the late 1980s and the pattern proved useful, so new compounds kept appearing. Some describe real problems and some are jokes in magazines. Only a few, notably power, sexual and maternity harassment, have legal weight.

Phrases you can use

  • That would count as power harassment.
  • Every company has to have a consultation desk now.
  • Write down the date and who was there.
  • Strict instruction isn't automatically harassment.
  • The labor bureau gives free advice.

Background
